The Supervisor led those in attendance in the Pledge of Allegiance. Further resolved to approve the Highway Superintendent to move forward with the purchase of a Vacuum Truck to be funded by the Highway Fund Balance with a maximum not to exceed purchase price of $378,342 and also resolved that any approved grant reimbursements will be applied back to the Highway fund and also resolved to approve the Town Supervisor to sign any and all documents that relate to said purchase.Upon Roll Call:  Supervisor Messa - AYE, Councilman Tehan – AYE, Councilman Reynolds - AYE, Councilman Latini - AYE, Councilman Pristera - AYE.  The Resolution was carried and adopted.A motion to approve the vouchers was offered by Councilman Latini and seconded by Councilman Tehan. RESOLUTION NO. 265  of 2026APPROVAL OF VOUCHERSResolved, that the Town Board does hereby approve the Abstract of Vouchers dated 8/5/26, Voucher Nos. 26-01092 through 26-01248, in the total amount of $1,313,519.35, and authorizes the Supervisor to issue payment thereof.Upon Roll Call:  Supervisor Messa - AYE, Councilman Tehan – AYE (with Abstain from Arrow Bank vouchers), Councilman Reynolds - AYE, Councilman Latini - AYE, Councilman Pristera - AYE.  The Resolution carried and was adopted.TOWN CLERK - Monthly ReportTown Clerk Moran reported monthly receipts totaling $25,505.04. Of this amount, $107 was remitted to the NYS Department of Agriculture & Markets for dog licenses, and $225 to the NYS Department of Health for marriage licenses. The remaining revenue was distributed to the Town’s general and part‑town funds.INTERMUNICIPAL AGREEMENT – DISTRICT WIDE SEWER REHABILITATIONCouncilman Reynolds made a motion to approve the Supervisor to sign the Intermunicipal Agreement for District-Wide Sewer Rehabilitation effective September 1, 2024.  Motion was seconded by Councilman Latini.RESOLUTION No. 266  of 2026INTERMUNICIPAL AGREEMENTINTERMUNICIPAL AGREEMENT AMONG THE TOWN OF NEW HARTFORD, THE COUNTY OF ONEIDA, AND THE MEMBERS OF THE ONEIDA COUNTY SEWER DISTRICT IN RELATION TO NEW YORK STATE ENVIRONMENTAL FACILITIES CORPORATION FUNDS FOR THE PLANNING, DESIGN AND CONSTRUCTION OF SEWER REHABILITATION PROJECTS IN VARIOUS LOCATIONS ACROSS THE ONEIDA COUNTY SEWER DISTRICT SERVICE AREAWHEREAS,   The New Hartford Town Board is in receipt of an Intermunicipal Agreement among Oneida County and the municipalities within the Oneida County Sewer District providing for the preservation of access rights, and continuance of public ownership, of each such municipalities’ sewer collection and conveyance systems during such times as improvements to such systems are financed through the Environmental Facilities Corporation, andWHEREAS,   The municipal counterparties to the Intermunicipal Agreement are the City of Utica, the Village of New York Mills, the Village of Yorkville, the Village of Whitesboro, the Village of Oriskany, the Village of New Hartford, the Village of Clayville, the Village of Holland Patent, the Town of Whitestown, the Town of New Hartford, the Town of Paris, the Town of Marcy, the Town of Deerfield, the Town of Frankfort, and the Town of Schuyler (collectively, the “Municipalities”), andWHEREAS,   Said Agreement is for a term commencing upon its execution and terminating at such time as any bonds or outstanding debt related to the improvement projects are fully paid, satisfied and discharged, andWHEREAS, Said Agreement must be approved by this Board, now therefore, be itRESOLVED, That the New Hartford Town Board hereby approves of and Supervisor James Messa to execute an Intermunicipal Agreement among the Town of New Hartford, Oneida County, and the other municipalities within the Oneida County Sewer District, for a term commencing upon its execution and terminating at such time as any bonds or outstanding debt related to the improvement projects are fully paid, satisfied and discharged, in the form annexed hereto.Upon Roll Call:  Supervisor Messa - AYE, Councilman Tehan – AYE, Councilman Reynolds - AYE, Councilman Latini - AYE, Councilman Pristera - AYE.  The Resolution was carried and adopted.RESOLUTION NO. 267  of 2026Presbyterian Home – Senior Center AgreementA motion to authorize the execution of the Agreement for Senior activities at the Presbyterian Home was made by Councilman Reynolds and seconded by Councilman Latini. It was agreed that Deputy Supervisor Tehan will sign the agreement as Supervisor Messa will be abstaining from the Vote.Upon Roll Call:  Supervisor Messa - Abstain, Councilman Tehan – AYE, Councilman Reynolds - AYE, Councilman Latini - AYE, Councilman Pristera - AYE.  The Resolution was carried and adopted.Supervisor Messa requested an overview of the Roman/Twyndom project where the Town is working off the County Bid for completion of a second retention pond.  A Cost Estimate for the work in progress was discussed at a cost not to exceed $347,006, which will be covered by the BAN.  Cost could go down based on the ability of the Highway Department to provide up to two trucks and drivers.  RESOLUTION NO. 268 of 2026Roman/Twyndom Retention PondA motion to proceed with the project on County Bid at a cost not to exceed $347,006 was made by Councilman Latini and seconded by Councilman Reynolds.Upon Roll Call:  Supervisor Messa - AYE, Councilman Tehan – AYE, Councilman Reynolds - AYE, Councilman Latini - AYE, Councilman Pristera - AYE.  The Resolution was carried and adopted.Supervisor Messa requested an overview of the Red Hill Road Project where the Town is working off the County Bid for completion of sidewalk and asphalt repairs and concrete outlet structures.  A cost estimate for the work in progress was discussed at a cost not to exceed $143,117, which will be covered by the BAN.  Cost could go down based on the ability of the Highway Department to provide up to two trucks and drivers.  RESOLUTION NO. 269  of 2026Red Hill Road Drainage Project – Option 2A motion to proceed with the project on County Bid at a cost not to exceed $143,117 was made by Councilman Pristera and seconded by Councilman Reynolds.Upon Roll Call:  Supervisor Messa - AYE, Councilman Tehan – AYE, Councilman Reynolds - AYE, Councilman Latini - AYE, Councilman Pristera - AYE.  The Resolution was carried and adopted.Supervisor Messa requested an overview of the Oneida Street 24” crossing near Hotel Willovale and Frank’s Garage where the Town is working off the County Bid for completion of sidewalk and asphalt repairs and concrete outlet structures and grates.  A cost estimate for the work in progress was discussed at a cost not to exceed $23,660 which will be covered by the BAN.  Cost could go down based on the ability of the Highway Department to provide up to two trucks and drivers.  RESOLUTION NO. 270  of 2026Oneida Street 24” crossingRESOLVED that the New Hartford Town Board does authorize Highway Superintendent Richard Sherman to proceed with the project on County Bid at a cost not to exceed $23,660.  Motion was made by Councilman Latini and seconded by Councilman Reynolds.Upon Roll Call:  Supervisor Messa - AYE, Councilman Tehan – AYE, Councilman Reynolds - AYE, Councilman Latini - AYE, Councilman Pristera - AYE.  The Resolution was carried and adopted.Supervisor Messa requested input on extending the Town’s Solar Moratorium for an additional six (6) months.  Attorney Cully spoke and said that it is not an uncommon practice and suggested a Resolution be offered.  RESOLUTION NO. 271 of 2026Solar moratorium extensionRESOLVED that the New Hartford Town Board does extend the Town’s Solar Moratorium for six (6) months.  Motion was made by Councilman Reynolds and seconded by Councilman Latini.Upon Roll Call:  Supervisor Messa - AYE, Councilman Tehan – AYE, Councilman Reynolds - AYE, Councilman Latini - AYE, Councilman Pristera - AYE.  The Resolution was carried and adopted.Town Attorney Cully offered Local Law Introductory “E” of 2026, a LOCAL LAW to amend the Code of the Town of New Hartford, Chapter 118 entitled “Zoning” and the map coincidental thereto, as it pertains to 13 parcels of real property owned by the Charles T. Gehringer for his dedicated and outstanding service, noting that Inv. Gehringer was a true asset to the Department and will be missed.RESOLUTION NO. 275  of 2026RESIGNATION OF INV.
