TOWN BOARD MEETING

TOWN OF NEW HARTFORD, NEW YORK 

HELD AT TOWN HALL, 8635 CLINTON STREET, NEW HARTFORD, NY 

ON THURSDAY, AUGUST 5, 2026 at 6:00 P.M.

Supervisor Messa called the meeting to order at 6:00 P.M. The Supervisor led those in attendance in the Pledge of Allegiance. The roll was then taken with the following Town Officials and Department Heads present:

PUBLIC HEARING – Zoning Board of Appeals Members pay

Councilman Latini made a motion to open the Public Hearing on Local Law Introductory “F”, A Local Law to amend that portion of the Code of the Town of New Hartford, Chapter 118-126, entitled “Creations, appointments, organization” as it relates to payment of the ZBA members and alternate members for attendance at meetings.  The motion was seconded by David Reynolds

Upon roll call: Councilman Latini – Aye Councilman Pristera – Aye Councilman Reynolds – Aye Councilman Tehan – Aye Supervisor Messa – Aye

Motion carried and the meeting was opened.

Attorney Herb Cully reviewed with the Board Local Laws Introductory “F” as submitted. There being no one in attendance that wished to speak on the matter, a motion to close the public hearing was made by Councilman Latini and seconded by Councilman Pristera.

Motion carried and the meeting was closed.

Thereafter, Councilman Latini moved and Councilman Tehan seconded that Local Law Introductory “F” of 2026 be adopted as Local Law No. 4 of 2026 in the following format:  A Local Law to amend that portion of the Code of the Town of New Hartford, Chapter 118-126, entitled “Creations, appointments, organization” as it relates to payment of the ZBA members and alternate members for attendance at meetings. 

RESOLUTION NO. 259  OF 2026

BE IT ENACTED BY THE TOWN OF NEW HARTFORD AS FOLLOWS:

LOCAL LAW 4 of 2026

A LOCAL LAW to amend that portion of the Code of the Town of New Hartford, Chapter 118-126, entitled “Creations, appointments; organization” as it relates to payment of the members and alternate members for attendance at meetings.

BE IT ENACTED by the Town Board of the Town of New Hartford

Section I.  Purpose

            This LOCAL LAW is intended to modify the attendance fee for members of the Zoning Board of Appeals.

Section II.  Attendance Fee

            Upon filing of this local law, that portion as it relates to the attendance fee for members shall be amended as follows:

            Zoning Board of Appeals members shall be paid an attendance fee as set by the Town Board regardless if there is a meeting held each month.  Members who miss a meeting shall not be paid the pro-rata attendance fee for that meeting as it will be paid to an alternate member for attendance.  Each month, the Board secretary shall provide an attendance report to the Town Board.

Section III.

            All other portions of Chapter 118 of the Code of the Town of New Hartford are herein affirmed.

Section IV.

            RESOLVED that this LOCAL LAW shall become effective immediately upon filing with the Office of the Secretary of State.

RESOLUTION NO. 260 OF 2026

Section I.  Purpose

APPROVAL OF MINUTES

Councilman Reynolds introduced the following Resolution for adoption; seconded by Councilman Latini:

RESOLUTION NO. 261 OF 2026

RESOLVED that the New Hartford Town Board does hereby accept and approve as submitted the minutes of the Regular Town Board meeting held July 9, 2026, and does further waive their reading.

RESOLUTION NO. 262 OF 2026

PARKINSONS WALK – BLUE LIGHTS

RESOLVED that the New Hartford Town Board does hereby approve the request made by Alison Swartz from Commnity Wellness Partners to light the Fountain at the Veterans Memorial Park blue colored lights in honor of people who are living with Parkinson’s Disease.  The blue lights would be during the week leading up to the weekend of the Parkinson’s Awareness Walk, Monday, September 7 through Sunday, September 13, 2026.

Councilman Reynolds introduced the following Resolution for adoption; seconded by Councilman Latini:

RESOLUTION NO. 263 OF 2026

NH LITTLE LEAGUE SIGN

RESOLVED that the New Hartford Town Board does hereby approve the request of Alan Leist of New Hartford Little League to install a Little League Community Welcome sign on Route 840 near the Town Line.

The Resolution was unanimously carried and duly adopted.

Councilman Reynolds introduced the following Resolution for adoption; seconded by Councilman Latini:

PURCHASE OF VAC TRUCK - HIGHWAY Department

Highway Superintendent, Richard Sherman recommended purchasing a Vacuum Truck using grant monies.  The grant was submitted on July 30, 2026.  The truck purchase price shall not exceed $378,342 and the Town will match 25% of the cost.  The grant is anticipated to come back at $400,000.

RESOLUTION 264 of 2026

Vehicle Purchase for HIGHWAY DEPARTMENT

RESOLVED that the New Hartford Town Board does authorize the purchase of a Vacuum truck for the Highway Department.  Motion was made by Councilman Latini and seconded by Councilman Reynolds. Further resolved to approve the Highway Superintendent to move forward with the purchase of a Vacuum Truck to be funded by the Highway Fund Balance with a maximum not to exceed purchase price of $378,342 and also resolved that any approved grant reimbursements will be applied back to the Highway fund and also resolved to approve the Town Supervisor to sign any and all documents that relate to said purchase.

Upon Roll Call:  Supervisor Messa - AYE, Councilman Tehan – AYE, Councilman Reynolds - AYE, Councilman Latini - AYE, Councilman Pristera - AYE.  The Resolution was carried and adopted.

A motion to approve the vouchers was offered by Councilman Latini and seconded by Councilman Tehan. 

RESOLUTION NO. 265  of 2026

APPROVAL OF VOUCHERS

Resolved, that the Town Board does hereby approve the Abstract of Vouchers dated 8/5/26, Voucher Nos. 26-01092 through 26-01248, in the total amount of $1,313,519.35, and authorizes the Supervisor to issue payment thereof.

Upon Roll Call:  Supervisor Messa - AYE, Councilman Tehan – AYE (with Abstain from Arrow Bank vouchers), Councilman Reynolds - AYE, Councilman Latini - AYE, Councilman Pristera - AYE.  The Resolution carried and was adopted.

TOWN CLERK - Monthly Report

Town Clerk Moran reported monthly receipts totaling $25,505.04. Of this amount, $107 was remitted to the NYS Department of Agriculture & Markets for dog licenses, and $225 to the NYS Department of Health for marriage licenses. The remaining revenue was distributed to the Town’s general and part‑town funds.

INTERMUNICIPAL AGREEMENT – DISTRICT WIDE SEWER REHABILITATION

Councilman Reynolds made a motion to approve the Supervisor to sign the Intermunicipal Agreement for District-Wide Sewer Rehabilitation effective September 1, 2024.  Motion was seconded by Councilman Latini.

RESOLUTION No. 266  of 2026

INTERMUNICIPAL AGREEMENT

INTERMUNICIPAL AGREEMENT AMONG THE TOWN OF NEW HARTFORD, THE COUNTY OF ONEIDA, AND THE MEMBERS OF THE ONEIDA COUNTY SEWER DISTRICT IN RELATION TO NEW YORK STATE ENVIRONMENTAL FACILITIES CORPORATION FUNDS FOR THE PLANNING, DESIGN AND CONSTRUCTION OF SEWER REHABILITATION PROJECTS IN VARIOUS LOCATIONS ACROSS THE ONEIDA COUNTY SEWER DISTRICT SERVICE AREA

WHEREAS,   The New Hartford Town Board is in receipt of an Intermunicipal Agreement among Oneida County and the municipalities within the Oneida County Sewer District providing for the preservation of access rights, and continuance of public ownership, of each such municipalities’ sewer collection and conveyance systems during such times as improvements to such systems are financed through the Environmental Facilities Corporation, and

WHEREAS,   The municipal counterparties to the Intermunicipal Agreement are the City of Utica, the Village of New York Mills, the Village of Yorkville, the Village of Whitesboro, the Village of Oriskany, the Village of New Hartford, the Village of Clayville, the Village of Holland Patent, the Town of Whitestown, the Town of New Hartford, the Town of Paris, the Town of Marcy, the Town of Deerfield, the Town of Frankfort, and the Town of Schuyler (collectively, the “Municipalities”), and

WHEREAS,   Said Agreement is for a term commencing upon its execution and terminating at such time as any bonds or outstanding debt related to the improvement projects are fully paid, satisfied and discharged, and

WHEREAS, Said Agreement must be approved by this Board, now therefore, be it

RESOLVED, That the New Hartford Town Board hereby approves of and Supervisor James Messa to execute an Intermunicipal Agreement among the Town of New Hartford, Oneida County, and the other municipalities within the Oneida County Sewer District, for a term commencing upon its execution and terminating at such time as any bonds or outstanding debt related to the improvement projects are fully paid, satisfied and discharged, in the form annexed hereto.

RESOLUTION NO. 267  of 2026

Presbyterian Home – Senior Center Agreement

A motion to authorize the execution of the Agreement for Senior activities at the Presbyterian Home was made by Councilman Reynolds and seconded by Councilman Latini. It was agreed that Deputy Supervisor Tehan will sign the agreement as Supervisor Messa will be abstaining from the Vote.

Upon Roll Call:  Supervisor Messa - Abstain, Councilman Tehan – AYE, Councilman Reynolds - AYE, Councilman Latini - AYE, Councilman Pristera - AYE.  The Resolution was carried and adopted.

Supervisor Messa requested an overview of the Roman/Twyndom project where the Town is working off the County Bid for completion of a second retention pond.  A Cost Estimate for the work in progress was discussed at a cost not to exceed $347,006, which will be covered by the BAN.  Cost could go down based on the ability of the Highway Department to provide up to two trucks and drivers.

Roman/Twyndom Retention Pond

A motion to proceed with the project on County Bid at a cost not to exceed $347,006 was made by Councilman Latini and seconded by Councilman Reynolds.

Upon Roll Call:  Supervisor Messa - AYE, Councilman Tehan – AYE, Councilman Reynolds - AYE, Councilman Latini - AYE, Councilman Pristera - AYE.  The Resolution was carried and adopted.

Supervisor Messa requested an overview of the Red Hill Road Project where the Town is working off the County Bid for completion of sidewalk and asphalt repairs and concrete outlet structures.  A cost estimate for the work in progress was discussed at a cost not to exceed $143,117, which will be covered by the BAN.  Cost could go down based on the ability of the Highway Department to provide up to two trucks and drivers.

A motion to proceed with the project on County Bid at a cost not to exceed $143,117 was made by Councilman Pristera and seconded by Councilman Reynolds.

Supervisor Messa requested an overview of the Oneida Street 24” crossing near Hotel Willovale and Frank’s Garage where the Town is working off the County Bid for completion of sidewalk and asphalt repairs and concrete outlet structures and grates.  A cost estimate for the work in progress was discussed at a cost not to exceed $23,660 which will be covered by the BAN.  Cost could go down based on the ability of the Highway Department to provide up to two trucks and drivers.

Oneida Street 24” crossing

RESOLVED that the New Hartford Town Board does authorize Highway Superintendent Richard Sherman to proceed with the project on County Bid at a cost not to exceed $23,660.  Motion was made by Councilman Latini and seconded by Councilman Reynolds.

Upon Roll Call:  Supervisor Messa - AYE, Councilman Tehan – AYE, Councilman Reynolds - AYE, Councilman Latini - AYE, Councilman Pristera - AYE.  The Resolution was carried and adopted.

Supervisor Messa requested input on extending the Town’s Solar Moratorium for an additional six (6) months.  Attorney Cully spoke and said that it is not an uncommon practice and suggested a Resolution be offered.

  RESOLUTION NO. 271 of 2026

Solar moratorium extension

RESOLVED that the New Hartford Town Board does extend the Town’s Solar Moratorium for six (6) months.  Motion was made by Councilman Reynolds and seconded by Councilman Latini.

Upon Roll Call:  Supervisor Messa - AYE, Councilman Tehan – AYE, Councilman Reynolds - AYE, Councilman Latini - AYE, Councilman Pristera - AYE.  The Resolution was carried and adopted.

Town Attorney Cully offered Local Law Introductory “E” of 2026, a LOCAL LAW to amend the Code of the Town of New Hartford, Chapter 118 entitled “Zoning” and the map coincidental thereto, as it pertains to 13 parcels of real property owned by the Charles T. Sitrin Health Care Center or its affiliates to correct and change the designation from MU (Mixed-Use) to PDDMU (Mixed-Use Planned Development).

RESOLUTION NO. 272  of 2026

Local Law Introductory “E” of 2026 – Sitrin zoning

RESOLVED that the New Hartford Town Board requests a scheduled public hearing on Local Law Introductory “E” of 2026.  Motion was made by Councilman Latini and seconded by Councilman Pristera.  Clerk Moran will schedule a Public Hearing for September 2, 2026 at 6:00 PM at the regularly scheduled Town Board Meeting.

Upon Roll Call:  Supervisor Messa - AYE, Councilman Tehan – AYE, Councilman Reynolds - AYE, Councilman Latini - AYE, Councilman Pristera - AYE.  The Resolution was carried and adopted.

Town Clerk Michele Moran offered a Fireworks Permit for a display at 10132 Mallory Road on August 15, 2026 and requested a motion to approve.  Town Attorney Cully reviewed certificate of insurance and approved.  .

A motion to approve the permit was made by Councilman Latini and seconded by Councilman Pristera.

Town Attorney Cully requested the Board approve a request by Sangertown Square to correct/amend Local Law 1 of 2025 to include what has been identified as a missing piece labeled “Exhibit A”.   

RESOLUTION NO. 273  of 2026

Local Law “1” of 2025

RESOLVED that the New Hartford Town Board does approve Clerk Moran to send “Exhibit A” with Local Law “1” of 2025 into the Secretary of State.  Motion was made by Councilman Reynolds and seconded by Councilman Pristera.  Clerk Moran to send “exhibit A” to the Secretary of State.

RESOLUTION No. 274  of 2026

SCHOOL SECURITY OFFICER - BROWDT

RESOLVED that the New Hartford Town Board does appoint Howard Browdt as a School Security Officer.  Motion was made by Councilman Reynolds and seconded by Councilman Latini.

Upon Roll Call:  Supervisor Messa - AYE, Councilman Tehan – AYE, Councilman Reynolds - AYE, Councilman Latini - AYE, Councilman Pristera - AYE.  The Resolution was carried and adopted.

Chief Fontaine advised the Board that with trepidation, he was sad to announce that he had accepted the resignation of Full Time Officer, Justin Gehringer, due to health reasons.  Chief Fontaine thanked Inv. Gehringer for his dedicated and outstanding service, noting that Inv. Gehringer was a true asset to the Department and will be missed.

RESIGNATION OF INV. JUSTIN GEHRINGER

RESOLVED that the New Hartford Town Board does accept the resignation of Officer Justin Gehringer, effective August 30, 2026.  Motion was made by Councilman Latini and seconded by Councilman Reynolds.

FULL TIME APPOINTMENT OF OFFICER SANEL GALijasevic

RESOLVED that the New Hartford Town Board does appoint promote Sanel Galijasevic to fill Full Time vacancy left by retirement of Officer Justin Gehringer.  Motion made by Councilman Latini and seconded by Councilman Pristera. Officer Galijasevic will start on 9/1/26 or later pending Civil Service approval.  Salary and benefits per PBA Contract.

Supplemental Services agreement – freidel williams & edmunds funeral home

Chief Fontaine requested authorization for the Town Supervisor to sign the Supplemental Services Agreement between the Police Department and Freidel, Williams and Edmunds Funeral Home for services rendered on July 29-July 30,2026.

RESOLUTION NO. 277 of 2026

SUPPLEMENTAL SERVICES AGREEMENT

RESOLVED that the New Hartford Town Board does approve and authorize the Supervisor’s signature on the Supplemental Services Agreement.  Motion was made by Councilman Reynolds and seconded by Councilman Latini.

Surplus of Police Vehicles and Equipment

The Chief reported the following sold prices for equipment recently sold a surplus:

2020 Police SUV, sale amount $4,700 (VIN ending A71231) 

2015 Police SUV, sale amount $2,700 or (VIN ending C27210) 

Box of assorted used emergency lights, sale amount $175

Box of metal vehicle partitions, sale amount $25

RESOLUTION No. 278 of 2026

Budget Transfer – Bond Counsel fees

A transfer was requested to reallocate funds to cover the expense bond counsel fees incurred from the BAN renewal from A16200-10 Buildings personnel services to Comptroller-Orrick Bond Counsel Fees, A13150-41 in the amount of $12,920.

BUDGET TRANSFER – BOND RATING FEES

To re-allocate funds to cover the expense associated with a bond rating review from A16200-10, Buildings Personal Services to A13150-43, Comptroller – Bond rating Fees in the amount of $7,000.

BUDGET TRANSFER – PURCHASE VAC TRUCK

To re-allocate funds to cover the purchase of a new Vac Truck from DB91200-00, Highway Part Town Fund Balance to DB51300-02 New Machinery in the amount of $378.342.00.

Asst. Director of Personnel, Christina Lacy addressed the Board regarding the recent proposals from brokers for the Town’s benefit package. After careful consideration, Adirondack Financial Services was recommended.  The Board discussed with Ms. Lacy her reasons to include assistance with a new employee handbook.

HEALTH INSURANCE BROKER

RESOLVED that the New Hartford Town Board does approve to engage Adirondack Financial Services to act at the Town’s health package broker. Motion made by Councilman Latini, seconded by Councilman Tehan.

Highway Superintendent, Richard Sherman presented the 2026 Intermunicipal Agreement for the Control of Snow and Ice on County Roads.

RESOLVED that the New Hartford Town Board does accept and allow Supervisor Messa to sign the 2026 Intermunicipal Agreement for the Control of Snow and Ice on County Road Motion was offered by Councilman Latini, Seconded by Councilman Pristera.

Highway Superintendent, Richard Sherman presented a quote from Tracey Road Equipment for a 2027 Western Star Model 49X SF and recommended purchasing it and the optional equipment at a total price of $425,579.

Vehicle Purchase for HIGHWAY DEPARTMENT – 2027 Western Star 49X SF

RESOLVED that the New Hartford Town Board does authorize the purchase of a 2027 Western Star Model 49X SF plow truck for the Highway Department.  Motion was made by Councilman Reynolds and seconded by Councilman Latini. Resolved to approve the Highway Superintendent to move forward with the purchase of the Truck to be funded by the Highway Fund Balance and also resolved to approve the Town Supervisor to sign any and all documents that relate to said purchase.

POSITIVE PAY AGREEMENT

RESOLVED that the New Hartford Town Board does authorize the execution of the Positive Pay Agreement with Arrow Bank for ACH checks.  Motin was made by Councilman Latini and seconded by Councilman Reynolds.

Upon Roll Call:  Supervisor Messa - AYE, Councilman Tehan – Abstain, Councilman Reynolds - AYE, Councilman Latini - AYE, Councilman Pristera - AYE.  The Resolution was carried and adopted.

EXECUTIVE SESSION – Chief Fontaine requests executive Session regarding an employee background investigation.
